Safety Data Sheet Terms

The seller warrants where a chemical being purchased requires a Safety Data Sheet (SDS) for conformance with OSHA’s Hazard Communication standard 29CFR 1910.1200, a SDS must be forwarded to the buyer’s safety department before the product arrives at the buyer’s plant. If a breach of this agreement occurs, the seller agrees to indemnify and hold harmless the buyer from all losses, claims, expenses, including attorneys’ fees, penalties or payments on account of such violation.
